1. Service Agreement

By booking driving lessons with Kriticals Defensive Driving School Limited, a limited liability company registered in Jamaica, you enter into a service agreement governed by the laws of Jamaica. Our services include but are not limited to:

• Defensive driving instruction and training
• Learner's permit test preparation
• Road test preparation and practice
• Vehicle safety and maintenance education
• Community mentorship programs (Drive to Thrive)

2. Student Eligibility & Requirements

• Students must be at least 17 years old or possess a valid learner's permit issued by the Island Traffic Authority (ITA) of Jamaica
• Students under 18 must have written parental or guardian consent
• Students must be physically and mentally fit to operate a motor vehicle
• Valid identification must be presented at the first lesson
• Students must disclose any medical conditions that may affect their ability to drive safely

3. Payment Terms

• Payment is required at the time of booking unless alternative arrangements have been made
• We accept cash, bank transfer, and online payment methods
• Prices are quoted in Jamaican Dollars (JMD) unless otherwise stated
• All payments are subject to applicable taxes as per Jamaican tax law
• Package deals must be paid in full before the first lesson unless a payment plan has been agreed upon in writing

4. Student Responsibilities

• Arrive on time for scheduled lessons; late arrivals may result in shortened lesson time
• Follow all instructions provided by the instructor for safety and learning purposes
• Refrain from using mobile phones or other electronic devices during lessons
• Not be under the influence of alcohol, drugs, or any substance that impairs driving ability
• Treat the instructor and training vehicle with respect
• Comply with all road traffic regulations as outlined in the Road Traffic Act of Jamaica

5. Instructor Rights & Safety

• The instructor reserves the right to terminate any lesson immediately if the student poses a safety risk
• The instructor may refuse service to students who are disrespectful, abusive, or non-compliant
• No refunds will be issued for lessons terminated due to student misconduct
• The instructor has full control of the vehicle at all times and may intervene for safety reasons

6. Liability & Insurance

Kriticals Defensive Driving School Limited maintains comprehensive motor vehicle insurance as required by Jamaican law. However:

• Students are responsible for any damage to the training vehicle caused by gross negligence or intentional misconduct
• Kriticals Defensive Driving School Limited is not liable for personal injuries sustained due to student negligence
• The company is not responsible for any traffic violations or fines incurred by the student after completion of training
• Students agree to indemnify and hold harmless Kriticals Defensive Driving School Limited, its instructors, directors, officers, and agents from any claims arising from their actions

7. No Guarantee of Test Success

While we provide comprehensive training and preparation, Kriticals Defensive Driving School Limited does not guarantee that students will pass their learner's permit test, road test, or any other examination administered by the Island Traffic Authority. Test results depend on individual student performance and the assessment of government examiners.

8. Intellectual Property

All training materials, handouts, and educational content provided by Kriticals Defensive Driving School Limited are for personal use only and may not be reproduced, distributed, or used for commercial purposes without written permission.

9. Modifications to Terms

Kriticals Defensive Driving School Limited reserves the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Jamaica. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Jamaica.

1. Eligibility for Refunds

Refunds may be requested in the following circumstances:

• Unused Lessons in Package Deals: If you have purchased a lesson package and have not used all lessons, you may request a refund for the unused portion
• Service Not Rendered: If we are unable to provide the service you paid for due to circumstances within our control
• Instructor Cancellation: If we cancel your lesson and cannot reschedule within a reasonable timeframe
• Medical or Emergency Circumstances: In cases of serious illness, injury, or family emergency (documentation may be required)

2. Non-Refundable Items

The following are NOT eligible for refunds:

• Completed lessons or sessions
• No-shows without prior notice (see Cancellation Policy)
• Lessons terminated due to student misconduct or safety violations
• Administrative fees, booking fees, or processing charges
• Promotional or discounted lesson packages after the first lesson has been taken
• Third-party fees (e.g., government test fees, permit application fees)
• Materials or resources already provided to the student

3. Refund Request Process

To request a refund, please follow these steps:

1. Submit a written refund request via email to [email protected]
2. Include your full name, contact information, booking reference number, and reason for refund
3. Provide supporting documentation if applicable (e.g., medical certificate, emergency proof)
4. Refund requests must be submitted within 30 days of the original purchase or incident

4. Refund Amount Calculation

Approved refunds will be calculated as follows:

• Before First Lesson: Full refund minus a 10% administrative fee
• After First Lesson (Package Deals): Refund based on unused lessons at the standard per-lesson rate (not package rate), minus completed lessons and administrative fees
• Weather or Instructor Cancellation: Full refund or free rescheduling at no additional cost
• Partial Lesson Completion: Prorated refund based on time not used (at instructor's discretion)

5. Refund Processing Time

• Refund requests will be reviewed within 5-7 business days
• Approved refunds will be processed within 14 business days of approval
• Refunds will be issued using the original payment method whenever possible
• For cash payments, refunds may be issued via bank transfer or cash pickup
• You will receive email confirmation once the refund has been processed

6. Alternative to Refunds

Instead of a refund, we may offer the following alternatives:

• Lesson Credit: Transfer your payment to future lessons (no expiration date)
• Rescheduling: Reschedule cancelled lessons at no additional charge
• Transfer to Another Person: Transfer your lesson package to a family member or friend (with written notice)

7. Disputes & Appeals

If your refund request is denied and you wish to appeal the decision, you may submit a written appeal to our management team within 14 days of the denial. Appeals will be reviewed on a case-by-case basis. Final decisions rest with Kriticals Defensive Driving School Limited management.

8. Consumer Protection

This refund policy complies with the Consumer Protection Act of Jamaica. For any unresolved disputes, you may contact the Consumer Affairs Commission of Jamaica at 1-888-991-5711 or visit www.cac.gov.jm.

2. How to Cancel or Reschedule

You can cancel or reschedule your lesson through any of the following methods:

• Phone: Call or WhatsApp +1 (876) 467-3191
• Email: Send cancellation notice to [email protected]
• Online Booking System: Cancel through our scheduling platform (if applicable)
• Text Message: Send SMS to our business number

Important: Always wait for confirmation of your cancellation. Lack of confirmation does not constitute a valid cancellation.

3. Emergency Cancellations

We recognize that genuine emergencies occur. Cancellation fees may be waived in the following circumstances (documentation required):

• Medical emergency or sudden illness (doctor's note or medical certificate required)
• Family emergency or bereavement (documentation may be requested)
• Vehicle breakdown preventing travel to lesson location
• Natural disaster or severe weather conditions making travel unsafe
• Mandatory work obligations or school emergencies (employer/school letter required)

Contact us as soon as possible if you experience an emergency. Management will review each case individually and make decisions at their discretion.

4. Instructor or School Cancellations

If Kriticals Defensive Driving School Limited needs to cancel your lesson, the following applies:

• We will notify you as soon as possible (minimum 24 hours when feasible)
• You will receive a full refund or free rescheduling at your convenience
• No cancellation fees will be charged to you
• Priority rebooking will be offered to affected students
• In case of instructor illness or emergency, we will attempt to arrange a substitute instructor or reschedule promptly

5. Weather-Related Cancellations

Jamaica's weather can be unpredictable. Our weather policy is as follows:

• Heavy Rain or Storms: Lessons may be postponed for safety reasons
• Tropical Storm or Hurricane Warnings: Automatic cancellation with free rescheduling
• Student Weather Concerns: You may cancel due to weather concerns without penalty if done at least 2 hours before the lesson
• Instructor Assessment: The instructor has final authority on weather-related safety decisions

All weather-related cancellations (by student or instructor) will not incur fees and may be rescheduled at no additional cost.

6. Late Arrivals

Punctuality is important for maximizing learning time:

• Students arriving up to 15 minutes late may proceed with a shortened lesson (no refund for lost time)
• Students arriving more than 15 minutes late may have their lesson cancelled and charged as a no-show
• Please contact us immediately if you know you will be late
• Instructors will wait a maximum of 15 minutes beyond the scheduled start time
• Repeated lateness may result in booking restrictions

7. Package Deal Cancellations

If you have purchased a multi-lesson package:

• Individual lesson cancellations within a package follow the same policy outlined above
• To cancel the entire package, see our Refund Policy for eligibility and terms
• Unused lessons in packages do not expire but must be used within a reasonable timeframe (typically 12 months)
• Package lessons cancelled as no-shows or late cancellations will be deducted from your package balance

8. Rescheduling Guidelines

• When rescheduling, please provide at least 2-3 preferred dates/times
• We will do our best to accommodate your schedule, subject to instructor availability
• Peak times (weekends and evenings) may have limited availability
• Rescheduled lessons should ideally be booked within 30 days

9. Policy Modifications

Kriticals Defensive Driving School Limited reserves the right to modify this cancellation policy at any time. Changes will be communicated to students and posted on our website. Lessons booked before policy changes will honor the policy in effect at the time of booking.
